The majority of the litigation we undertake is Commercial or Corporate litigation in the Isle of Man High Court.
The practice has since inception acted on behalf of both domestic and internationally based clients involved in commercial and corporate litigation.
Our preferred areas of work are International Commercial Disputes e.g.
- Shareholders disputes
- Asset freezing injunctions
- Corporate insolvency
- Pension Cases
- Contentious Compliance Work
- Trust disputes - including trusts involved in commercial schemes (see heading Trust and Estates)
The cases are typically Chancery Court cases which in England would be dealt with in the commercial Court.
Recent cases include shareholders disputes, trust disputes, winding up proceedings (both contested and uncontested), injunctions, directors disqualification proceedings, banking litigation, professional negligence claims and general civil litigation.
The majority of our commercial cases involve quite complex points of law and are before the Chancery Court. The sizes of the claims vary enormously and not all involve claims for money or monies worth. Those that do seek damages tend to be for sums above £1 million but have been as high as $US 1.5 Billion when the claims become multi jurisdictional.
Due to the international nature of business on the Island, litigation often either involves individuals or corporations whose home country may be thousands of miles away from the Island, or parties who are conducting litigation in a number of different jurisdictions at the same time. Over the years we have established good working relationships with a number of leading law firms around the world and have a track record of successfully assisting clients wherever they may reside.
